A 21-year-old mother in Texas has been taken into custody after her one-year-old baby drowned in a Round Rock apartment bathtub earlier this year. Victoria Tristan reportedly fell asleep for approximately 10 minutes while leaving her toddler unattended in a filling bathtub, causing the child to eventually drown. Tristan has since been charged with injury to a child, a first-degree felony in the state, for the tragic death of her baby that unfolded on January 18.
According to the arrest affidavit, the woman told officers that she had placed her child in a bathtub and "washed her off with running water." She then walked away and began texting a family member while sitting on a bed. Victoria then leaned over to briefly rest her head and fell asleep for a few minutes, revealed the affidavit.
On waking up, she rushed to the bathroom only to find her baby drowning in the overflowing tub. Tristan immediately removed the child from the tub and administered CPR but the child, unfortunately, remained unresponsive, reports KXAN.
During the investigation, authorities recovered her cellphone data that indicated that Tristan had indeed been texting a family member while leaving her toddler unattended in the tub. She had been texting someone for five minutes, according to the affidavit. And there was an eight-minute gap between the last text and the 911 call she made requesting help.
The arrest affidavit also indicated that Tristan had searched YouTube before contacting the authorities, reports PEOPLE. First responders arrived three minutes after she made the call. The Travis County Medical Examiner ruled the child's death an accident noting the cause of death was determined to be drowning.
However, authorities stated that by leaving her child in the bathtub alone, Tristan knowingly, by omission, caused serious bodily injury. She put her one-year-old in "harm's way" deliberately. Tristan is currently in custody at Williamson County jail.
Previously, a nine-month-old baby drowned in a bathtub after his parents fell asleep. The baby was found face down in the bathtub at around 11.30 a.m. in his Florida home. Twenty-nine-year-old Heather Clifford had the infant in the bathtub alone for 20 minutes along with two of his siblings, aged two and three, before falling asleep in another room.

The boy's father Shawn Davis, 30, was also sleeping when the tragic incident occurred, according to a report by The Daily Mail. "For some period of time, at least 20 minutes, that child was left alone in the bathtub. When she came back she found the baby what they described as blue. Obviously it had drowned," revealed Martin County Sheriff William Snyder. "It’s a sad situation. It’s terrible. You know, it’s a 9-month-old baby. It’s Christmas. These are the hardest things for our detectives to work," said Sheriff Snyder, according to a report by CBS12.
